Interpretation of Guiding Opinions on Further Strengthening the Safety System Construction of New En

Recently, the Ministry of Industry and Information Technology, the Ministry of Public Security, the Ministry of Transport, the Emergency Management Department and the General Administration of Market Supervision (hereinafter referred to as the 'five departments') jointly issued the Guiding Opinions on Further Strengthening the Safety System Construction of New Energy Automobile Enterprises (No.10 [2022] of the Ministry of Industry and Information Technology, hereinafter referred to as the Opinions). Now, the relevant contents of the Opinions are interpreted as follows:

I. Compilation background

Developing new energy vehicles is the only way for China to move from a big automobile country to a powerful automobile country. The CPC Central Committee and the State Council attach great importance to the development of new energy vehicle industry. In recent years, with the joint efforts of all parties concerned, China's new energy automobile industry has achieved remarkable results, with its production and sales ranking first in the world for seven consecutive years, the rapid improvement of product technology level, the gradual establishment of industrial ecosystem and the continuous improvement of supporting environment. At the same time, the whole industry's awareness of safety issues has been deepened, the safety level of new energy vehicle products has been significantly improved, and the overall safety situation has continued to improve.

However, it should also be noted that with the rapid growth of ownership and the increasing number of old vehicles, the quality and safety risks of new energy vehicle products still exist, and the quality assurance system of some enterprises still needs to be improved; At the same time, with the emergence of new problems such as network security and data security, the connotation and extension of new energy vehicle security are also changing. In order to further compact the main responsibility of new energy automobile enterprises, establish and improve the product safety guarantee system, practically improve the product safety level, and promote the high-quality development of new energy automobile industry, the five departments jointly formulated and issued the Opinions according to their respective responsibilities on the basis of the preliminary work and in accordance with the relevant requirements of the New Energy Automobile Industry Development Plan (2021-2035).

II. Compilation process

Since 2021, five departments have organized industry forces, carried out special research, and started the drafting of documents.

First, extensive and in-depth research. Investigated major domestic new energy automobile enterprises, industry organizations and testing and inspection institutions, and carried out safety system inspection of 17 major new energy automobile enterprises, comprehensively studied and analyzed the safety level, safety risks and major problems of new energy automobile products, and accurately grasped the new situation and new demands of product quality and safety.

The second is to fully listen to the opinions of all parties. Organize industry enterprises to hold special seminars for three times, and listen to the opinions and suggestions of all parties on the drafting of documents. Subsequently, according to the opinions and suggestions of industry enterprises, combined with the problems found in the inspection, the draft Opinions was revised and improved for several rounds. In October, the 'Opinions' draft was formed, and the relevant departments and the society were publicly consulted.

The third is to revise and improve the 'Opinions'. According to the situation of soliciting opinions and feedback, a special study was made on related issues, the relevant contents of the enterprise monitoring platform were adjusted, and the relevant requirements such as the network security guarantee system were enriched and improved, and finally the Opinions were formed.

III. Main contents

The Opinion consists of 8 parts, 22 articles and 1 annex.

The first is to clarify the positioning of the Opinions. The Opinions adhere to the guidance of Xi Jinping's new era of socialism with Chinese characteristics, make overall plans for development and safety, guide enterprises to speed up the construction of a systematic, scientific and standardized safety system, effectively improve product safety level and promote high-quality industrial development.

The second is to improve the safety management mechanism. Put forward opinions from the aspects of organizational guarantee, safety education and training. Enterprises should make clear the departments responsible for safety management and promote the construction of safety system as a whole. Improve the safety management system, organize regular safety education and training, and improve staff's safety awareness and related skills.

The third is to ensure product quality and safety. Suggestions on product design, supplier management, production quality control and power battery safety. Enterprises should formulate and continuously improve product safety design guidance documents, strengthen product online and offline testing, strengthen supplier management and encourage them to actively cooperate with the opening of necessary data protocols, and carry out design collaboration with battery suppliers.

The fourth is to improve the efficiency of the monitoring platform. Suggestions are put forward from the aspects of operation monitoring, data mining and hidden trouble investigation. Enterprises should monitor the running safety of vehicles in accordance with relevant standards. Encourage enterprises to strengthen the analysis and mining of operational data, strengthen the investigation and proper handling of vehicle safety hazards.

The fifth is to optimize the after-sales service capability. Suggestions are put forward from the aspects of service network construction, maintenance service and consumer use. Enterprises should make a reasonable layout and ensure that all outlets have the necessary after-sales service and emergency response capabilities, and disclose relevant maintenance technical information. Encourage enterprises to refine product maintenance projects, carry out sampling inspection of hidden dangers, and guide consumers to cultivate good car maintenance habits.

Sixth, strengthen accident response and disposal. Put forward opinions from the aspects of emergency response, accident investigation, problem analysis and recall. Enterprises should establish and improve emergency response methods and plans for safety accidents of different vehicles and different scenes, strengthen accident reporting, investigation and analysis, and take corresponding improvement measures. Enterprises should earnestly fulfill the legal obligation of recall.

Seventh, improve the network security system. Put forward opinions from the aspects of network security, data security and personal information protection. Enterprises should establish and improve relevant management systems and operating rules, improve safety protection capabilities, and monitor vehicle network security status, data processing and personal information processing according to laws and regulations.

Eight is to organize the implementation. Put forward opinions on organization and implementation for enterprises, relevant departments and industry organizations respectively. New energy enterprises should speed up the establishment and improvement of safety system, and all parts suppliers, after-sales service and other related enterprises should cooperate with each other. 5. Departments will work together with relevant departments to strengthen information sharing and post-event supervision, and local relevant departments will strengthen daily supervision and inspection according to laws and regulations. Industry organizations give full play to the role of industry self-discipline and technical support.
